Ease of Doing Business
Bioenergy investors will find that Nigeria's investment entry framework is broadly aligned with the wider renewable energy sector, with the same foundational steps applying; CAC registration within one to seven days, no minimum share capital, and full foreign ownership rights. From a tax perspective, the standard 30% CIT and 7.5% VAT rates apply, alongside the RE sector's Pioneer Status Incentive offering a three-to-five-year CIT holiday that is extendable and available through the NIPC portal.
Import duties on eligible RE equipment — turbines, generators, processing machinery — attract 0% duty and VAT exemption under the ECOWAS Common External Tariff and 2026 NTA exemptions, which is a meaningful cost advantage given the capital intensity of bioenergy plant development. Applicable Laws & Policies
The overarching framework rests on the Electricity Act 2023, which governs grid-connected and captive bioenergy power generation. Sitting alongside it are the National Bioenergy Policy and Action Plan and the National Bio-Fuels Policy, both specific to bioenergy. Supporting instruments include the National Integrated Electricity Policy 2025, Nigeria's updated Nationally Determined Contributions (NDCs), and the Energy Transition Plan 2022, which anchors bioenergy within the country's 2060 net-zero pathway. The Land Use Act 1978 applies wherever large-scale land acquisition for feedstock or plant siting is required.
Different Frameworks
Bioenergy splits into two distinct regulatory tracks depending on the product. Feedstock procurement itself currently sits outside any dedicated bioenergy framework, operating under existing agricultural and forestry regulations.
Electricity Generation Track
Governed by NERC. A Generation License is required for grid-connected projects above 1 MW; a Captive Generation Permit applies for self-use at or above 1 MW; a separate Generation License is required to sell surplus of 1 MW or above to third parties; and a Mini-Grid Permit applies for projects under 1 MW.
Biofuels Production Track
Governed by the Nigerian Upstream Petroleum Regulatory Commission (NUPRC), which licenses ethanol and biodiesel plants for production and blending, working alongside the Bio-Fuels Energy Commission (BFEC), which provides licensing, monitoring, policy oversight, incentives, and offtake agreement facilitation.
Regulatory Requirements
CAC incorporation typically completes within 1–7 days; foreign investors may retain 100% ownership. NIPC registration via OSIC is recommended for fiscal incentive access, including a 3–5-year Pioneer Status tax holiday.
FMEnv EIA is mandatory for all bioenergy projects with environmental impact above 10 MW. The 2026 process follows eight steps: registration; Terms of Reference; site verification; laboratory analysis; draft submission; 21-working-day public display; technical review; and certification.
Land acquisition for large-scale projects requires the state Governor's Consent under the Land Use Act 1978. Net billing for excess generation is available under Section 80 of the Electricity Act 2023.
Fiscal incentives include 0% import duty on biomass harvesting and bioenergy conversion equipment via Nigeria Customs Service; IDEC Scheme via Federal Ministry of Finance; VAT exemptions via NRS; EDTI via NIPC (5% annual tax credit on qualifying capex for 5 years); and full exemptions for NEPZA or OGFZA Free Trade Zone projects.

Technical Standards
All imported equipment must meet NIS/IEC standards. SON administers SONCAP for imports and MANCAP for locally manufactured products, including specific product quality standards for bioenergy systems. NEMSA certification is mandatory wherever electricity infrastructure is involved. RMRDC supports sustainable feedstock supply standards, though no dedicated bioenergy feedstock licensing framework currently exists.
